These terms apply to all visitors, users, and others who access or use the service. Please read the details of the agreement carefully below.

is owned and operated by A THOUSAND WORDS, L.D.A., a company legally registered and tax-resident in Portugal, and governed by Portuguese commercial and tax law.
Order fulfillment, packaging, and physical dispatch of artworks are conducted from Berlin, Germany. This fulfillment location does not alter the applicable governing law, tax jurisdiction, or contractual obligations of the Company.
All contracts of sale are concluded under Portuguese law, regardless of the location from which the physical shipment is dispatched.

AVAILABILITY

The artworks we make are limited editions. Editions are strictly limited to one unit per customer unless otherwise specified. Once each edition is sold, it will no longer be available.

Advertised product offerings and prices by the Company are valid only until they are visible on the site and/or until stocks are exhausted, whether or not the website is updated to reflect current availability.

The Company does not guarantee the availability of any product for sale for any specified period but shall in good faith fulfill orders as they are received while stocks last.
SHIPPING, RISK OF LOSS & INSURANCE
All artworks are carefully packed and shipped from Berlin, Germany via DHL or DHL International. Dispatch times shown on the website are estimates only and not guaranteed.
Risk of loss and responsibility for the artwork transfers to the buyer immediately upon physical handover of the shipment to the carrier (DHL). From that moment onward, the shipment travels entirely at the buyer’s risk.
Basic carrier insurance may apply depending on destination and service level. Full-value shipping insurance is optional but strongly recommended. If the buyer declines additional insurance coverage, the Company shall not be liable for loss, theft, or damage beyond the base carrier compensation limits.
Damage Claim Procedure (Strict):
If an artwork arrives damaged, the buyer must notify both info@tavarzawacki.com
and DHL within 48 hours of delivery. The buyer must provide:
– Photographs of the external packaging
– Photographs of the internal packaging
– Clear images of the damaged artwork
Failure to provide this documentation within the required timeframe may result in claim rejection.
The Company, as shipper of record, will initiate damage claims with DHL once complete documentation is received.
Incorrect or incomplete delivery address details provided by the buyer are the buyer’s full responsibility. Any reshipping, return, storage, or recovery costs arising from address errors shall be borne entirely by the buyer.
The Company does not ship to P.O. Boxes.
TITLE TRANSFER & OWNERSHIP
Legal ownership (title) of the artwork transfers to the buyer only upon full and successful payment of the purchase price. Risk of loss transfers in accordance with the “Shipping, Risk of Loss & Insurance” section of these Terms.
PAYMENT
All prices displayed on www.tavarzawacki.com/shop
are expressed in Euros (€). Applicable VAT is included or excluded according to Portuguese and European Union tax law, depending on the buyer’s location and legal status.
Order confirmation does not constitute acceptance of a contract of sale. A binding contract is formed only after successful payment authorization and confirmation by the Company.
Payments are processed securely via Shopify Payments. Depending on buyer location and availability, accepted payment methods may include but are not limited to:
– Visa
– Mastercard
– American Express
– PayPal
– Apple Pay
– Google Pay
– Shop Pay
– Klarna and localized installment services (if enabled)
– SEPA Direct Debit / Sofort (if enabled)
Chargebacks, reversals, and payment disputes are governed by the buyer’s payment provider and Shopify Payments. The Company reserves the right to submit all relevant documentation including order confirmation, tracking confirmation, delivery confirmation, and photographic evidence where applicable to dispute any unauthorized or improper claim.
Cryptocurrency payments are not accepted.
TRADEMARKS
All names, logos, product and service names, designs, graphics, and slogans are trademarks of A THOUSAND WORDS, L.D.A., the artist Tavar Zawacki, or their respective affiliates and licensors. You must not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify such marks without prior written permission. All rights are protected under applicable national and international intellectual property laws.
RETURNS, VARIATIONS & FINAL SALE POLICY
All artworks sold on www.tavarzawacki.com/shop
are offered as final sale unless otherwise explicitly stated in writing.
All artworks are handmade by the artist. Due to the nature of contemporary handmade production, each work may contain natural variations including, but not limited to:
– Minor surface texture differences
– Subtle color variations
– Pigment density shifts
– Micro bubbles in resin
– Slight alignment irregularities
These characteristics are inherent to the artistic process and do not constitute defects.
The following are not grounds for return, refund, or exchange:
– Change of personal preference
– Subjective aesthetic judgment
– “I no longer like it”
– Digital screen color variation
– Micro surface variations inherent to handmade production
This policy does not affect the buyer’s non-waivable rights under applicable EU consumer protection law in cases of verified transport damage or proven material non-conformity upon arrival.
CUSTOMS, TAXES, COLOR DISCLAIMER & FORCE MAJEURE
All import duties, VAT, customs handling charges, and regulatory fees imposed by destination countries are the sole responsibility of the buyer.
The Company is not responsible for seized, confiscated, delayed, abandoned, or refused shipments resulting from customs regulations, governmental inspections, or buyer inaction.
All artworks are photographed and displayed as accurately as possible. However, screen calibrations vary between devices. Color variation between digital representation and physical artwork does not constitute grounds for refund or return.
The Company shall not be held liable for delays or non-performance resulting from events beyond reasonable control including, but not limited to:
– Natural disasters
– War
– Customs inspections
– Transportation strikes
– Border restrictions
– Acts of government
TERMINATION
If you breach the terms, we may terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation.
All provisions of the terms which by their nature should survive termination shall survive termination, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
